How We Collect Phone Numbers: We collect mobile phone numbers when you voluntarily provide them through our contact forms, property inquiry forms, or other communication channels on our website. You have the option to opt-in to receive SMS text messages by checking the SMS consent checkbox.

SMS Consent: Your consent to receive SMS messages is completely optional and separate from email consent. You can choose to receive email communications only, SMS only, or both. Consent to SMS messaging is not a condition of using our real estate services or purchasing property.

How We Use Phone Numbers: Phone numbers are collected to provide you with real estate services including property updates, appointment reminders, market insights, and direct communication with our agents. We will only send SMS messages to phone numbers that have explicitly opted in through our consent process.

SMS vs. Email Data Usage: Phone numbers used for SMS are treated with the same privacy protections as email addresses. However, SMS data is subject to additional regulations under A2P 10DLC (Application-to-Person) and TCPA (Telephone Consumer Protection Act) compliance requirements.

Third-Party SMS Service Provider: We use Twilio, a trusted third-party service provider, to deliver text messages. When you opt-in to SMS communications, your phone number is securely transmitted to Twilio for message delivery. Twilio processes your phone number in accordance with their privacy policy and industry-standard security practices. We have a data processing agreement with Twilio to ensure your information is protected.

SMS Data Storage and Security: Your phone number is stored in our secure database with industry-standard encryption. Only authorized Lewis & Co. personnel have access to phone numbers for legitimate business purposes. We implement technical and organizational measures to protect your phone number from unauthorized access, disclosure, or misuse.

SMS Data Retention Policy: We retain your phone number and SMS consent records for as long as you maintain active consent or as required for legal compliance purposes. Phone number retention includes: (1) Active consent records while you remain opted-in to SMS, (2) Opt-out records for compliance purposes (minimum 4 years), (3) Message delivery logs as required by carrier regulations.

SMS Data Deletion Requests: You have the right to request deletion of your phone number from our systems at any time. To request deletion, contact us at jay@jaysells.ca or (780) 220-8449. Note that we may retain certain records for legal compliance even after deletion requests.

Geographic Targeting and Availability: SMS services are currently available only to phone numbers in the United States and Canada. We do not send SMS messages to international phone numbers. Our messaging system automatically validates phone numbers for geographic eligibility.

Your SMS Privacy Rights: You may opt-out of SMS messages at any time by replying STOP to any message or by contacting us directly. Your phone number will never be sold, rented, traded, or shared with third parties for their marketing purposes. You will only receive SMS messages that you have explicitly consented to receive.

SMS Analytics and Tracking: We track SMS delivery rates, opt-out rates, and engagement metrics to improve our communication services. This tracking is anonymized and used only for service improvement purposes.

Age Verification for SMS: You must be 18 years of age or older to consent to receive SMS messages. By providing consent, you certify that you are of legal age.

Your personal information is stored on our secure database.
